Acceptance of terms

Using the Service means you agree to these Terms.

Service description

Ember is a personal CRM available as iOS and Android apps, with an AI assistant called Keeper and optional encrypted cloud sync.

Account requirements

• You must be at least 13 (or the minimum digital-consent age in your country). If you are under 18, you need a parent or guardian’s consent to make purchases.
• Provide accurate information and keep your sign-in credentials secure.
• You are responsible for activity under your account.

Subscription & billing

• Free: $0 forever — 20 contacts, 5 Ember Points / day, 5 active reminders.
• Pro: $9.99 / month or $79 / year (99,000₫ / month or 790,000₫ / year).
• Ultra: $19.99 / month or $179 / year (199,000₫ / month or 1,790,000₫ / year).
• Subscriptions are billed through Apple In-App Purchase (iOS) or Google Play Billing (Android) and auto-renew until cancelled.
• Manage or cancel anytime in your Apple or Google subscription settings; cancellation takes effect at the end of the current period.
• Refunds are handled under Apple’s and Google’s standard policies. Prices may change with advance notice.

Ember Points

• Ember Points (EP) power the AI features. One AI query = one Point.
• Free: 5 EP / day. Pro: 100 EP / day. Ultra: 200 EP / day.
• Points reset every 24 hours and do not roll over.
• Points have no monetary value and cannot be transferred, refunded, or exchanged.

Acceptable use

• No illegal content, and no data you have no right to keep.
• No harassment, spam, or scraping.
• No reverse engineering, and no reselling access.

User content

• You own the contacts, notes, and other content you create.
• You grant us only the limited license needed to store, process, and display your content to provide the Service.
• You can export and delete your data anytime from Settings.

Intellectual property

• The Ember name, logo, design, and code are the property of Vũ Đăng Công.
• No license is granted to copy, create derivatives, or redistribute them.

AI features (Keeper)

• Keeper’s answers are suggestions, not facts, and may be inaccurate or incomplete.
• You are responsible for verifying AI output before acting on it; it is not professional, legal, medical, or financial advice.
• Ember does not read your synced data (it is Row-Level-Security isolated) and does not use it to train AI models or for any purpose other than running the features you ask for. To run these features, only the context needed is sent to our third-party AI providers (OpenAI, Google Gemini, DeepSeek, and Anthropic Claude — detailed in the Privacy Policy) and processed under their own terms.

Disclaimers

• The Service is provided “as is”, without warranties of any kind.
• No warranty of uninterrupted, error-free, or virus-free operation.
• Best-effort uptime; no SLA at the current pricing tiers.

Limitation of liability

• To the maximum extent permitted by law, liability is capped at the amount you paid in the last 12 months.
• We are not liable for indirect, incidental, or consequential damages, or for loss of data.

Termination

• You may terminate anytime via Settings → Data → Delete account.
• We may suspend or terminate access for violations of these Terms, with 30 days’ notice (immediately for fraud or abuse).
• Payment obligations, intellectual property, and the liability cap survive termination.

Governing law & disputes

• These Terms are governed by the laws of Vietnam.
• Disputes are resolved first through good-faith negotiation; if unresolved, by arbitration in Hanoi.

Changes to terms

We may update these Terms as Ember evolves. We will revise the “Last updated” date and, for material changes, give 30 days’ notice by email and an in-app banner.
